Privacy Policy

NOUS, Inc. (“we,” “us,” or “our”) is a voice AI platform incorporated in Delaware and headquartered in the United States. This Privacy Policy explains how we collect, use, disclose, and protect personal information in connection with our service — an AI-powered phone answering system deployed on behalf of our business clients (tire shops and auto service businesses) across the United States and Canada.

We are subject to applicable US federal and state privacy laws, including the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA) for California residents. For our Canadian users, we also comply with Canada's Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy legislation. By using our website or interacting with our AI over the phone, you acknowledge the practices described in this policy.

1. Who This Policy Covers

This policy applies to two categories of people:

  • Business clients — tire shops and auto service businesses in the US and Canada that subscribe to NOUS.
  • End callers — members of the public who call a business that uses NOUS to answer its phones.

If you are a business client, additional terms in your service agreement also govern our data practices.

2. Information We Collect

From end callers (people who call a NOUS-powered business)

  • Call recording and transcript — your call is recorded and transcribed using our voice AI platform.
  • Name — if you provide your name during the call.
  • Phone number — your caller ID, captured automatically.
  • Inquiry details — information you share, such as tire sizes, service needs, or appointment requests.
  • Call metadata — date, time, duration, and outcome of the call.

From business clients

  • Business name, address, and contact details.
  • Authorized user names and email addresses for dashboard access.
  • Billing information (processed by our payment processor; we do not store full card details).
  • Inventory and business configuration data you provide to us.

From website visitors

  • Standard server log data (IP address, browser, referring URL, pages visited).
  • Information you submit via contact or demo request forms.

From Instagram direct messages (Meta / Instagram Graph API)

When you message a NOUS-powered business on Instagram, we receive the following from Meta via the Instagram Graph API and Instagram Messaging API:

  • Your Instagram-scoped user ID (IGSID) and public username.
  • The content of direct messages you send to the business, including any text, attachments, or media you explicitly share.
  • Public profile information permitted by the Instagram Messaging API (such as name and profile picture) solely to personalize the reply.
  • Message timestamps and conversation metadata.

3. Call Recording Disclosure

Calls handled by NOUS are recorded and transcribed by an AI assistant. Recording consent requirements vary by jurisdiction:

  • One-party consent states and federal law — the majority of US states and US federal law require only one party to consent to recording. The AI, acting on behalf of the business, provides that consent.
  • All-party consent states — several states, including California, Florida, Illinois, Maryland, Massachusetts, Michigan, Montana, Nevada, New Hampshire, Oregon, Pennsylvania, and Washington, require all parties to consent before recording begins. Businesses operating in these states are solely responsible for notifying callers before the AI greets them.
  • Canada — under Canadian federal law, one-party consent is sufficient.

If you do not wish to have your call recorded, you may decline to continue the call and contact the business by other means.

4. How We Use Personal Information

  • To provide the phone answering and AI assistant service on behalf of our business clients.
  • To log call outcomes and generate analytics for the business client's dashboard.
  • To extract structured data from transcripts using AI.
  • To enable the business client to follow up with leads and callers.
  • To improve the accuracy, safety, and performance of our AI — using de-identified or aggregated data only.
  • To process payments and manage billing for business clients.
  • To respond to inquiries submitted via our website.
  • To comply with legal obligations.

We do not sell personal information to third parties. We do not use caller data for advertising or marketing purposes.

5. How We Share Personal Information

We share personal information only as necessary to operate the service:

  • Business clients — call logs, transcripts, and caller information are shared with the business client whose phone line was called.
  • Voice and AI infrastructure providers — our platform relies on third-party cloud services to process audio, generate transcripts, and operate the AI assistant in real time.
  • Data storage providers — call logs and business data are stored with third-party cloud database providers.
  • Payment processor — billing information for business clients is handled by our payment processor.
  • Authorities — if required by law, court order, or to protect our rights or the safety of others.

6. Instagram / Meta Platform Integration — Limited Data Use

If a business client connects its Instagram account to NOUS, we process Instagram direct messages on that business's behalf using the Instagram Graph API and the Instagram Messaging API. Our access to, use of, and transfer of information received from Meta is subject to the Meta Platform Terms, the Developer Policies, and the applicable Limited Use requirements.

Limited Data Use commitments

  • We use data obtained from the Instagram Graph API solely to provide and improve the user-facing features of the NOUS service — answering direct messages, capturing leads, booking appointments, and generating the business client's analytics dashboard.
  • We do not use Instagram data for advertising, retargeting, or cross-app tracking, and we do not combine it with data from other sources to build advertising profiles.
  • We do not sell, rent, or license Instagram data, and we do not transfer it to data brokers, ad networks, or any party that would use it for advertising or analytics unrelated to the service.
  • We do not use Instagram data to train general-purpose or third-party AI/ML models. De-identified, aggregated statistics may be used only to monitor and improve the reliability of the NOUS service itself.
  • Human access to Instagram message content is restricted to authorized NOUS personnel on a need-to-know basis (e.g., to investigate a reported bug or abuse report) and is logged.

Sharing of Instagram data

Instagram direct-message content and associated identifiers are shared only with:

  • The business client whose Instagram account you messaged (via its NOUS dashboard).
  • Infrastructure sub-processors strictly required to deliver a reply — our voice/LLM providers, cloud hosting, and database storage — each of which is contractually bound to equivalent confidentiality and Limited Use terms.
  • Authorities when required by law, court order, or to protect rights and safety as described in Section 5.

Retention and deletion of Instagram data

  • Instagram message content follows the retention schedule in Section 7 (up to 12 months, then permanently deleted).
  • If a business client disconnects its Instagram account, or if the user or Meta revokes our access token, we stop processing new Instagram data immediately and delete cached Instagram conversation data within 30 days, except where longer retention is required by law.
  • You may request deletion of your Instagram data at any time by emailing hello@callnous.com with the subject line “Instagram Data Deletion Request” (see Section 9). We will honor the request within 30 days.

User controls

You can stop all data collection at any time by unsending your messages in Instagram, blocking the business account, or managing your permissions in Instagram Settings → Apps and Websites. Meta also provides its own privacy controls at facebook.com/privacy/center.

7. Data Retention

  • Call logs and transcripts — retained for 12 months after the call date, then permanently deleted.
  • Business client account data — retained for the duration of the subscription and for 90 days after termination.
  • Billing records — retained for 7 years as required by applicable tax law.
  • Website inquiries — retained for up to 12 months.

8. Security

We implement industry-standard technical and organizational measures to protect personal information against unauthorized access, disclosure, alteration, or destruction. These include encrypted data transmission (TLS), access controls, and limited employee access on a need-to-know basis.

9. Your Privacy Rights

California residents (CCPA/CPRA)

  • Right to Know — request disclosure of the categories and specific pieces of personal information we have collected.
  • Right to Delete — request deletion of personal information we have collected.
  • Right to Correct — request correction of inaccurate personal information.
  • Right to Opt Out of Sale or Sharing — we do not sell or share personal information for cross-context behavioral advertising.
  • Right to Non-Discrimination — we will not discriminate against you for exercising any of the above rights.

Canadian residents (PIPEDA)

Canadian residents have the right to request access to personal information we hold about them, request correction of inaccurate information, and withdraw consent to collection or use.

For all regions: if your data was collected on behalf of a specific business client, we may need to direct your request to that client. We will respond to all requests within 30 days (45 days for California).

10. Cookies and Website Tracking

Our website uses only essential cookies required for functionality. We do not use third-party advertising cookies or cross-site tracking.

11. Children's Privacy

Our service is intended for businesses and adults. We do not knowingly collect personal information from individuals under the age of 18.

12. Cross-Border Data Transfers

NOUS is headquartered in the United States. Some of our third-party sub-processors may store or process data in the United States or other jurisdictions. By using our service, you acknowledge these transfers.

13. Changes to This Policy

We may update this policy from time to time. Material changes will be communicated to active business clients by email.
